Credential Terms & Conditions
Notice of Credential Terms and Conditions for Use
This credential is issued by TrackTown Events, LLC ("TTUSA") to an approved individual (the "Bearer") solely to provide authorized access to a person with a legitimate working function in connection with the event for which the credential is issued (the "Event").
In some instances, this credential may be issued to an accredited organization (the "Organization") which then provides the credential to its selected Bearer. This credential is non-transferable, remains the property of TTUSA, and must be worn in full view at all times while on-site. TTUSA may revoke this credential at any time in its sole discretion.
Unauthorized Use / Revocation
Any unauthorized use of this credential may result in removal from the venue, denial of access, and may subject the Bearer to criminal trespass or other legal action. Unauthorized use may also result in the revocation of future credential access for the Bearer and/or Organization, as determined by TTUSA in its sole discretion.
Credential security: To protect access control and event security, Bearers must not photograph, screenshot, scan, copy, or post images of their credential (front or back) on social media or anywhere online. Sharing credential images (including barcodes/QR codes/serial numbers) may be treated as misuse and may result in immediate revocation.
Credentials reported as lost or stolen may not be honored, and replacement is not guaranteed. TTUSA may require a credential to be surrendered upon request.
Non-Permissible Activities
While on-site (including venue perimeter areas controlled by TTUSA), the Bearer may not: solicit contributions, tips, donations, or business; or distribute, post, or circulate literature, promotional items, or advertising materials; or engage in any commercial activity not expressly authorized in writing by TTUSA.
The Bearer acknowledges that the Event is subject to a Rights Protection Program and agrees not to engage in any conduct that may constitute ambush marketing, unauthorized commercial association, or infringement of the Event’s intellectual property, sponsorship, marketing, or media rights. The Bearer further agrees to comply with all clean venue and commercial exclusivity requirements applicable to the Event.
Photography, Recording, and Use of Event Content
All photography, filming, audio recording, and other content capture is subject to TTUSA and Event broadcast/media policies and any instructions from TTUSA staff.
If the Bearer is accredited media: any photos, audio, video, interviews, or other event content captured under this credential may be used only for bona fide news/editorial coverage of the Event, and may not be used for advertising, sponsorship, promotional, or other commercial purposes without advance written permission from TTUSA (or the applicable rights-holder). Additional restrictions may apply to live or in-progress coverage and to video clips.
If the Bearer is not accredited media: any photos/video/audio captured by the Bearer may be used only for personal, noncommercial use, and may not be broadcast, sold, licensed, published, live-streamed, or otherwise disseminated (including online) without prior written consent from TTUSA (or the applicable rights-holder).
Intellectual Property
TTUSA (and/or applicable rights-holders) retains all copyrights, trademarks, and other proprietary rights in Event names, marks, logos, designs, and Event production elements. Nothing in this credential grants the Bearer or Organization any license or ownership interest in TTUSA intellectual property.
SafeSport, Protection of Minors, and Reporting Expectations
TTUSA is committed to athlete safety-particularly the safety of minors. The Bearer agrees to comply with all applicable safeguarding requirements communicated for the Event, including any requirements related to the protection of minors and abuse prevention standards (including, where applicable, Minor Athlete Abuse Prevention Policies/"MAAPP").
TTUSA may require the Bearer to complete SafeSport (or equivalent safeguarding) training in advance of the Event as a condition of credential issuance or continued access. Any conduct that jeopardizes participant safety may result in immediate revocation and removal, and may be referred to appropriate authorities or governing bodies as applicable.
Use of Bearer's Image / Likeness
By using this credential, the Bearer grants TTUSA (and its Event partners/rights-holders) the right to record, reproduce, and use the Bearer's name, image, voice, and likeness in any live or recorded broadcast, display, or other transmission or depiction of all or any part of the Event in any media, without compensation.
Assumption of Risk; Release; Indemnification
The Bearer assumes all risks incidental to attending the Event and agrees to release TTUSA and the Event's venue, organizers, affiliates, agents, and employees from liability arising from the Bearer's presence on-site, except where prohibited by law.
If this credential is issued through an Organization, the Bearer and/or Organization may be required to indemnify and hold harmless TTUSA and related parties from claims arising out of the Bearer's actions, presence, or content capture/use in connection with the Event (including claims involving intellectual property or publicity rights).
Code of Conduct
Bearer must at all times conduct themselves in a professional manner and comply with all Venue rules and TTUSA Codes of Conduct.
Interpretation; Disputes
These Credential Terms & Conditions shall be governed by, and interpreted in accordance with, the laws of the State of Oregon (excluding its conflicts of laws rules), regardless of where the credential was issued or used. At the sole option of TTUSA, any dispute arising out of or related to this credential (including its issuance, use, or revocation) may be resolved by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. Arbitration hearings shall be convened in Lane County, Oregon.
Health and Safety
Bearer agrees to comply with all health and safety protocols established for this event. Bearer voluntarily assumes all risks related to exposure to communicable diseases.
